Thank you for attending Cyber Security for Small and Mid-size Businesses at this year’s Cyber Security Summit. Cyber security is a pressing issue for all of us, including your mid-size or small business. Here are some basic steps to remember:

Prepare

    • Ensure that your contracts contain the right promises regarding data security
    • Align your internal and external policies with your business practices and applicable law
    • Make an informed decision regarding cyber insurance
    • Plan for an incident – know the team you will use if there is an incident

React

    • When there is an incident, get legal counsel on board right away
    • Implement a technical fix to the problem
    • Evaluate insurance coverage and contract issues

Remediate

    • Work with legal counsel to identify notification and disclosure obligations
    • Work with legal counsel to identify regulatory issues arising out of the breach
    • Identify lessons learned and incorporate into future incident response plans

Litigate

    • If you need to start or defend a lawsuit, consult with counsel experienced in both privacy law and cyber security

Phil Schenkenberg leads the Privacy, Data Security and Cybersecurity practice group at Briggs and Morgan, P.A., and advises on legal compliance, negotiates contracts and helps clients prevent, prepare for, and minimize the impacts of security breaches and cyber-attacks. Phil is active on cybersecurity issues locally, including through his membership in InfraGard (Minnesota chapter). Phil is the former co-chair of Briggs’ Business Litigation section and practices in the areas of telecommunications and financial services litigation. He has tried complex cases before courts and administrative agencies in more than ten states.

Cyrus Malek is a member of the Business Litigation section and the Privacy, Data Security and Cybersecurity group at Briggs and Morgan, P.A. He practices principally in the areas of complex commercial litigation, appellate representation and data security matters. Cyrus offers a broad range of services to help clients prevent, prepare for, and minimize the impact of security breaches and cyber attacks. Cyrus obtained his certification in Cybersecurity and Privacy Law from Mitchell-Hamline School of Law in 2016. He is a member of InfraGard (Minnesota chapter), a non-profit organization creating a partnership between U.S. businesses and the FBI, focusing on the development, management and protection of infrastructure. Cyrus also serves on the firm’s Information Security Committee and is a member of the Cyber Security Summit’s Small/Mid-Market Business Planning Committee.
